precedent はラテン語 praecēdō（～より先に進む・先行する）、その形 praecēdēns に由来する。prae-（前に）+ cēdō（進む・譲る・退く）で、「前へ進んだもの」という構成であり、prae- はさらに *prai-（前に）につながる。
過去に先に起きた事件や判決が、後の判断の手本として前に置かれることから、「先例」という意味になった。cede／ceed を見たら「進む」、pre- を見たら「前に」と考えると、precedent は「前に進んだ先行例」として覚えられる。
