覚え方
ラテン語 dērogātiō(法の一部廃止) = dērogō(法の一部を廃する)+ -tiō(行為・結果を表す)。法律まるごとではなく「一部を削り取る」のが原義で、そこから一般に「一部を差し引くこと・減少」の意味が出た。
dērogō の背景には *h₃reǵ-(まっすぐにする・正す) があり、まっすぐに定められた規範を思わせる。derogation は「決まりの一部を欠けさせる」動きだと捉えると、価値や名誉を「損なう」意味の derogatory(軽蔑的な)ともつながる。
補足: EU 法や条約の文脈では「適用除外・特例」という定訳で頻出する。動詞は derogate(from を伴って「〜を損なう」)。
